At The Tallowed Truth (“The Tallowed Truth,” “we,” and “our”), we are committed to safeguarding the privacy of our customers and users (“Customers,” “you,” and “your”) of our The Tallowed Truth brand website (the “Site”) and products. This Privacy Policy sets out how we collect and use information from and about you when you visit the Site, including your personal information. By accessing and using the Site, you consent to this Privacy Policy.

1. COLLECTING PERSONAL INFORMATION

When you visit the Site, we collect certain information from and about you, including the electronic device you are using, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. (a) Device Information

Examples of device information we collect are: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.

We collect this information so we can load the Site accurately for you, and to perform analytics on Site usage to optimize our Site.

We collect device information automatically when you access our Site using cookies, log files, web beacons, tags, code, or pixels. 

We may share your device information with third parties for purposes of processing your purchases, such as Shopify.

Additionally, when you visit our website, log in, register or open an email, cookies, ad beacons, and similar technologies may be used by our online data partners or vendors to associate these activities with information they or others have about you, including your email address. We (or service providers on our behalf) may then send communications and marketing to these email addresses. (b) Order information

Order information includes your Personal Information. Examples include: your name, email address, phone number, billing address, shipping address, and payment information such as credit card numbers or PayPal account information.

We collect and use the order information to provide you the products and services you purchase from us, to process your payment, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We collect order information directly from you when you register with us and/or make your purchase. We share this information with Shopify and other vendors for purposes of processing and delivering your purchases.

(c) Customer Support Information

When you request support from us in using the Site or making a purchase, we may collect your email address, phone number, and other contact information directly from you. We use this information to provide you the support you need.

2. MINORS

The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.

3. SHARING PERSONAL INFORMATION

We share your Personal Information with our third party service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

Other than our service providers who need your Personal Information to help us provide our services and fulfill our contracts with you, we will only provide your Personal Information to third parties without your authorization under the following circumstances: (a) to enforce our privacy policy, to comply with law, regulation, or other legal processes or to protect the rights, property or safety of us or others, (b) to a government regulator, law enforcement agency, or other public authorities, including to meet national security standards, (c) in emergency situations, (d) to protect against misuse or unauthorized use of the Site, (e) to detect or prevent criminal activity or fraud, or (f) in the event that The Tallowed Truth or substantially all of its assets are acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation or liquidation, in which case Personal Information may be one of the transferred assets.

4. BEHAVIORAL ADVERTISING

We may use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you.

5. USING PERSONAL INFORMATION

We use your personal Information to provide our services to you, which includes: offering products for sale, marketing and advertising, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

6. PRIVACY LAWS

Canadian provincial and US state consumer privacy laws may provide their residents with additional rights regarding our collection and use of their Personal Information. 

California law permits users who are California residents to request certain information regarding any disclosures of Personal Information we make to third parties for direct marketing purposes. If you are a resident of California, you have the right to access the Personal Information we hold about you (also known as the “Right to Know”), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. - Correct inaccuracies in their Personal Information, taking into account the information's nature processing purpose.

Nevada currently or will provide its residents with a limited right to opt-out of certain Personal Information sales.

7. INTERNATIONAL PRIVACY LAWS

International data protection laws may give Customers certain rights regarding their Personal Information. 

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your Personal Information under the following lawful bases:

- Your consent;

- The performance of your contract to purchase goods and services from us;

- Compliance with our other legal obligations;

- To protect your vital interests;

- To perform a task carried out in the public interest; or

- For our legitimate interests, which do not override your fundamental rights and freedoms.

If you are located within the EEA or Canada, you may ask us to take the following actions related to your Personal Information:

- Opt-out. Stop sending you direct marketing communications. You may continue to receive service-related and other non-marketing emails. 

- Access.  Provide you with information about our processing of your Personal Information and give you access to your Personal Information.

- Correct.  Update or correct inaccuracies in your Personal Information.

- Delete.  Delete your Personal Information.

- Transfer.  Transfer a machine-readable copy of your Personal Information to you or a third party of your choice.

- Restrict.  Restrict the processing of your Personal Information.

- Object.  Object to our reliance on our legitimate interests as the basis of our processing of your Personal Information.  

You can submit these requests using the contact information at the end of this Privacy Policy. We may request specific information from you to help us confirm your identity and process your request. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions. If you would like to submit a complaint about our use of your Personal Information or our response to your requests regarding your Personal Information, you may contact us or submit a complaint to the data protection regulator in your jurisdiction.

(a) Correcting Your Information

Contact The Tallowed Truth using the information at the end of this Privacy Policy if you want to access, review, correct or delete the Personal Information collected from you by The Tallowed Truth. To protect your privacy and security, The Tallowed Truth requires a Customer or User ID and password to verify your identity before granting you the right to access, review, or make corrections to your Personal Information. Please be advised that certain Personal Information may not be corrected or deleted if we must by law retain such information as submitted.

(b) Disclosure of Information

We reserve the right to disclose your Personal Information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order or legal process. 

It is also possible that The Tallowed Truth would sell its business (by merger, acquisition or otherwise) or sell all or substantially all of its assets. In any transaction of this kind, Customer information, including your Personal Information, may be among the assets that are transferred. If we decide to transfer your Personal Information, you will be notified by an email sent to the last know email address in our files or by notice posted on the Site.

(c) Retention of Information

We will only retain your Personal Information for as long as necessary to fulfil the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.

When we no longer require the Personal Information we have otherwise collected about you, such as when you cease to be a registered Customer, we will dissociate such identifying information from the Personal Information attached to your content to the extent possible while retaining such information only so long as needed to comply with business, legal or regulatory obligations and requirements. In some circumstances we may anonymize your Personal Information (so that it can no longer be associated with you), in which case we may use this information indefinitely without further notice to you.

(d) International Transfers of Information

Customers located outside of the United States, including all Customers located in the EEA and Canada (“International Users”), are hereby notified that their Personal Information may be collected, used, disclosed, transferred and stored in the United States. By accepting this Privacy Policy, International Users consent to the collection, use, disclosure, transfer, and storage of their Personal Information in the United States for the purposes stated in this Privacy Policy. Personal information of International Users will be subject to lawful access requests from U.S. governmental agencies for as long as it is stored in the United States.

For Customers residing in the EEA, whenever we transfer your Personal Information to the United States, or other countries not deemed by the European Commission to provide an adequate level of personal data protection, the transfer will be made:

- Pursuant to the recipient’s compliance with current Standard Contractual Clauses adopted by the European Commission or Binding Corporate Rules; or

- Pursuant to the consent of the individual to whom the Personal Information pertains; or

- As otherwise permitted by EEA law.

Personal Information processed for us by Shopify will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. (e) Automatic Decision Making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using Customer data.

Our information processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

- Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.

- Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

8. COOKIES

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the Site to remember your actions and preferences (such as login and region selection). This means you don’t have to re-enter this information each time you return to the site or browse from one page to another. Cookies also provide information on how people use a website, for instance whether it’s their first time visiting or if they are a frequent visitor.

The length of time that a cookie remains on your computer or mobile device depends on whether it is a “persistent” or “session” cookie. Session cookies last until you stop browsing and persistent cookies last until they expire or are deleted. Most of the cookies we use are persistent and will expire between 30 minutes and two years from the date they are downloaded to your device.

Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

9. CUSTOMER CONSENT, CHANGES

If you acknowledge that you have reviewed this Privacy Policy and accept its terms when registering to use the Site or otherwise, then you have expressly consented to the use of your Personal Information as stated in this Privacy Policy. You may withdraw your consent to the use of your Personal Information, unless you are doing so to avoid a legal obligation to The Tallowed Truth. The Tallowed Truth’s continued use of your Personal Information, after you withdraw your consent to its use, may be required for The Tallowed Truth to comply with federal and provincial laws and regulations.

We will change this Privacy Policy periodically. The date at the end of this Privacy Policy indicates when the most recent changes to this Privacy Policy were posted. By using this Site after any changes to the Privacy Policy become effective, then you are expressly consenting to the use of your Personal Information as stated in this Privacy Policy. We recommend you check this Privacy Policy periodically for changes.
